In cases where there is an identifiable child, or adult at risk who is making the allegation or has been subjected to harm/abuse then the relevant processes related to investigating abuse, harm & neglect under Section 3
of these procedures will be carried out by social services in accordance with the Social Services and Well-being (Wales) Act 2014. The outcome of this process must be fed back to the LADO/ DOS.
Normally, local arrangements will dictate if the LADO/DOS attends the initial strategy discussion held by children’s/adult services.
The LADO/DOS remains responsible for taking forward the section 5 process if it is decided that it meets one of the four criteria considerations. The outcome of child/adult at risk processes will be fed back to the LADO/DOS, with attendance and participation within the Section 5 Professional Strategy Meeting.
The LADO/DOS must be kept informed of the outcome of any investigations and discussion should take place as to what information can be shared with children, parents/adults & their families in relation to the allegation process whilst these investigations are ongoing.
When a referral is made under Wales Safeguarding Procedures Section 5 and is third party, the adult at risk/child, who is subject of the referral must be spoken to by adult social care/children’s social care, even when they have not made a disclosure themselves, in line with other requirements of the safeguarding procedures. Where there are identifiable victim (adult at risk/child) we must ensure that opportunity appropriate to their age and/or capacity has been provided for them to speak with a relevant practitioner to make sure we capture their voice within the process.
